Committee hears testimony on LB 60

The Nebraska Legislature's Judiciary Committee heard testimony regarding LB 60. Senator Brett Lindstrom introduced the bill as a reaction to a state Supreme Court decision that allowed a mother to maintain custody of her two daughters after she married a registered sex offender. The girls' father had sued for custody.
A district court rejected the father's request, and a four-justice majority on the Nebraska Supreme Court in August upheld the ruling, finding that the father didn't prove his ex-wife's new husband posed a risk to the girls.Lindstrom's measure would shift that burden of proof to the parent or guardian who allows a registered sex offender to spend unsupervised time with a child. It starts with the presumption that living with or otherwise spending unsupervised time with a sex offender is not in a child's best interest.The bill also would require everyone with custody or access rights to be notified that a sex offender is living with or has unsupervised access to the child.

I was going to post a comment went to the trouble to type it all out and then tried to login... oops you have to have a Facebook account registered citizens are banned by Facebook from being on their system effectively quelling my voice news organizations that do this allow comments from specific groups and not others should be sued for violating First Amendment rights.

    At any rate here was the comment that I was going to post
    This legislation like all the other laws that have been passed affecting sex offenders is based on the common the lie that is used to justify taking away any American citizens rights and that is the presumption that they're going to commit a crime.

    This is especially true with people involved with any type of sex crime. But the reality is that registered citizens, that is people on the registry, have the lowest re-offense rate of any criminal class. It is less than 1% as proven by the Nebraska legislators recidivism study where they showed a re-offense rate of 6/10 of 1%. So who are committing all the new sex crimes if not people on the registry? Studies have shown that clergy are twice as likely teachers three times more likely and law enforcement 14 times more likely than somebody that is on the registry. This bill does not protect children from the people most likely to abuse them.

    One parting thought when our independent judiciary makes a decision based on the Constitution they are upholding everyone's rights. So if a husband and wife have got a divorce and the wife has complete custody of the children what is the reason that the biological father does not have some custody?
